		<description>Although I understand &quot;thelaw is the law&quot;, I do think she could&#039;ve stuck her neck out.  The evidence was offered late, the killer was convicted and sentenced, and he remained in jail for 16 years.  Sometimes, a judge has to do whatever they can do to protect the innocent.  

Does fairness and morality have a place in the legal system?  Deskovic is now a law student and hopes to eventually help others avoid his plight.  I&#039;ll be interviewing him over the weekend and will be happy to keep you posted if you&#039;re interested.</description>

		<description>Anthony, the acceptability of DNA testing in New York was still being debated in 1994, so I&#039;m not sure if DNA evidence was presented at his Deskovic&#039;s 1989 trial, or later, on appeal.  Either way, from what I understand, the judge wasn&#039;t Sotomayor.  Secondly, the reporter in the video says that the appeal Sotomayor ruled on could have shaved 6 years off his sentence, so he had already been in jail 10 years, was not a boy, and had lawyers representing him that should have been aware of basic filing procedure.  Mr. Deskovic&#039;s story is sad, but Sotomayor had nothing to do with his conviction, and her empathy, compassion and/or competence does not seem to be an issue here.

I&#039;m not an attorney, but if I were, I think I would trust the info coming from the court as to filing dates, etc.   To consider following incorrect direction from the court as being negligent is a bit much, if you ask me.
